End-User License Agreement

Vixeldorf grants you a non-exclusive, non-transferable licence to install and use the Software for your own internal professional purposes, subject to this EULA. Free plugins are provided free of charge. Paid products and paid (“Premium”) features — for example ShaftMaster and the CAD_EX / nanoCAD_EX Premium commands — are licensed to you upon purchase.

The Software is a professional aid intended solely for qualified professionals exercising independent professional judgement. It is not a consumer product and is not intended for personal, family or household use.

You must not: reverse engineer, decompile or disassemble the Software (except to the extent this restriction is prohibited by applicable law); redistribute, resell, rent or sublicense it; or remove any proprietary notices.

The Software modifies your Revit / CAD models — for example by moving elements, changing parameters, adjusting Space limits or creating geometry. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING BACKUPS OF YOUR PROJECT FILES BEFORE RUNNING THE SOFTWARE.

You must always review the results visually and must not rely on any automated result without independent verification. Vixeldorf is not liable for any loss of, or damage to, models, data or project files.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIXELDORF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, MODELS, PROJECT FILES OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SOFTWARE.

VIXELDORF’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) US$50.

We may, but are not obliged to, provide support, updates, or bug fixes for the Software. Any support is provided on a reasonable-efforts basis.

This licence continues until terminated. It terminates automatically if you breach it, in which case you must stop using and uninstall the Software.

Nothing in this EULA excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

This EULA is governed by the laws of the State of Israel, with exclusive jurisdiction in the competent courts of Tel Aviv-Jaffa, Israel. If any provision is held unenforceable, it shall be limited to the minimum extent necessary and the remainder shall continue in full force.
